Is it a prerequisite that I file an operating statement?

Asked 2 years ago

We’re in the process of forming an LLC, and I want to get it done as soon as possible. I have been tasked with handling the paperwork and all the admin of registering the company. I need to make sure I meet all the requirements, but I’m not sure if the law requires us to prepare an operating statement.

That depends on your state - some states require that you file an operating statement for your LLC, while others do not. Five states require an operating statement: Delaware, California, New York, Missouri, and Maine. The other states don't require an operating statement, though it is highly recommended.
